Terms of Service

These Terms of Service (“Terms”) govern your use of the acalandscape.com website and the landscape, irrigation, and snow removal services provided by A Cut Above Landscape (“ACA Landscape,” “we,” “us,” or “our”). By using our website or purchasing services from us, you agree to these Terms.

These Terms are split into two parts:

  • Part A: Website Terms — covers your use of our website.
  • Part B: Service Agreement — governs services you purchase from us.

Part A: Website Terms

1. Use of the website

You may use our website for lawful purposes only. You agree not to:

  • Copy, scrape, or republish content without permission
  • Attempt to gain unauthorized access to our systems
  • Use the site to transmit malicious code or spam
  • Impersonate any person or entity

2. Intellectual property

All content on acalandscape.com, including text, graphics, logos, photos, and code, is the property of A Cut Above Landscape or our licensors and is protected by copyright and trademark law. You may not reproduce it without permission.

3. Disclaimer

The website is provided “as is” without warranties of any kind. We do our best to keep information accurate and up to date, but we do not warrant that the site will be error-free or uninterrupted.

Our site may link to third-party websites. We are not responsible for their content or practices.


Part B: Service Agreement

This Service Agreement is made between A Cut Above Landscape (“Contractor”) and you (“Client”) when you purchase services from us. By accepting a quote or making a payment, you agree to these terms.

5. Services and authorization

ACA Landscape agrees to furnish labor and materials for the services you purchase at the property address you provide. You represent and warrant that you have the authority to grant us the right to perform services at that property. The specific methods and materials used will be determined by ACA Landscape.

You agree to notify us in writing if ownership of the property changes. Active subscriptions may be transferred to a new owner at the same property if both parties agree.

6. Service term

  • Landscape Maintenance subscriptions run April 1 through October 31 annually.
  • Winter Maintenance subscriptions run November 1 through March 31 annually.
  • Mid-season starts begin on the date of initial payment.
  • Subscription start date is separate from service start date. Your service schedule is sent separately after payment.

7. Auto-renewal

For continuity of service, Landscape Maintenance and Winter Maintenance contracts automatically renew for another full term at the end of each term. To cancel or change your package, you must notify us in writing at least 30 days before the renewal date. All other terms remain in effect during any renewal period.

8. Service quantities and frequency

  • Mowing services are weekly unless your custom quote specifies otherwise.
  • We begin scheduling services upon receipt of initial payment. Service dates are emailed automatically.
  • Initial mowing service may be delayed up to 7 days from payment to allow for route scheduling.
  • To prevent turf damage during shoulder months, mowing quantity is reduced by half in April and October. Your subscription price already reflects this.
  • Services may be delayed by weather or holidays. Rescheduling notifications are sent by email.
  • Recurring services skipped for reasons outside our control (weather, customer request, access issues) are not refunded. Your contract price includes 5 free buffer visits to absorb these situations.
  • A $25 trip charge applies for requested return trips when the crew cannot access all service areas (for example, locked gates). Return trips are not guaranteed.
  • Snow removal begins within 6 hours after snowfall ends between 4 AM and 8 PM local time, or once per day during continuous multi-day snowfall.

9. Payments

Landscape Maintenance and Winter Maintenance subscriptions:

  • Total subscription amount is paid in equal monthly installments, or as a single installment if Prepayment is selected.
  • Monthly billing: First and last month installments are due immediately to reserve your spot on the route and are non-refundable. Remaining installments are processed monthly in advance.
  • Prepayment (annual) billing: Total is due immediately to reserve your spot and unlock the 5% discount. Prepayment is non-refundable but may be transferred on change of ownership.

General payment terms:

  • Availability is first-come, first-served. Your spot is not confirmed until initial installments are paid in full.
  • You authorize us to automatically charge your payment method on the agreed schedule.
  • Late fees: Failed payments accrue a 2% per month late fee.
  • We may suspend services at our sole discretion when a payment is past due. We are not liable for any costs or damages resulting from a suspension for non-payment.
  • If collection action becomes necessary, you agree to pay all reasonable collection costs, including attorney’s fees, court costs, and arbitration costs.

Inflation adjustment: Season prices will increase each renewal term by a percentage equal to the change in the Consumer Price Index over the previous 12 months, as published by the U.S. Bureau of Labor Statistics at bls.gov. This calculation will not reduce the season price below the prior year.

Additional price increases: We reserve the right to increase renewal pricing beyond the inflation adjustment. Written notice will be provided at least 45 days before the renewal date.

10. Overgrowth surcharges

When you request lawn care, we assume grass is under 6 inches tall unless you tell us otherwise. Lawns over 6 inches are considered overgrown. By ordering service, you agree to any applicable overgrown surcharges needed to safely bring your lawn back to manageable height. We will always provide photo documentation of overgrown charges.

Tiers:

  • 6” to 12”: +50% of the standard cut price
  • 12” to 24”: +100% of the standard cut price
  • 24” or taller: Requires a custom quote

11. Damages and liability

ACA Landscape is not responsible for damage caused by events outside our control, including vandalism, natural causes, acts of God, drought, or unusually dry or wet weather.

We are also not responsible for damage to sub-surface lines, including but not limited to invisible pet fences, cable TV, security lines, irrigation, lighting, gas grill or pool equipment lines, or any items buried under snow.

All de-icers and sand-salt mixes may cause damage to landscape, concrete, and paved surfaces. We use these materials prudently to provide a safe environment, but we are not responsible for damage these products may cause.

If we directly damage your property through our work (outside the exclusions above), we will repair, replace, or reimburse the reasonable replacement cost. You must provide written notice of any damage within 7 days of it occurring.

We are not liable, under any circumstances, for incidental, consequential, special, expectation, punitive, or exemplary damages.

Both parties acknowledge that snow and ice create hazardous conditions. You agree to hold ACA Landscape and our employees harmless from all claims and liabilities arising from snow, ice, sand, gravel, slush, snow melt, or ice melt.

12. Termination

This Service Agreement may be canceled immediately by either party upon written notice. Email notice to service@acalandscape.com is acceptable. Non-refundable installments (first month, last month, or prepayment) remain non-refundable on cancellation.

13. Governing law

These Terms are governed by the laws of the State of Colorado without regard to conflict-of-law principles. Any dispute arising from these Terms or our services will be resolved in the state or federal courts located in Adams County, Colorado.

14. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top will reflect the most recent version. Continued use of our website or services after changes means you accept the revised Terms.
